How Surplus Funds Cases Work in Practice
The following are anonymized examples illustrating the types of cases Donovan Law handles. They are not specific case results and do not guarantee any particular outcome.
A homeowner's property was sold at a mortgage foreclosure auction. The sale price exceeded the mortgage balance and costs. The former owner had relocated out of state and was unaware that surplus funds were being held by the Clerk of Superior Court. Donovan Law researched the case, filed the claim, and handled the disbursement process.
A property owner passed away before the foreclosure was completed. The estate had not been fully administered. Donovan Law worked with the heirs to address the probate issues, establish the proper claimant, and successfully recover the surplus funds from the court.
An LLC that owned a commercial property was foreclosed upon. The LLC had been dissolved, and the members were uncertain whether they had a valid claim. Donovan Law researched the LLC's operating agreement and NC law, identified the proper claimants, and filed the claim on their behalf.
Multiple parties — a former owner, a judgment creditor, and a second mortgage holder — all filed claims to the same surplus funds. Donovan Law represented the former owner, analyzed the priority of each claim under NC law, and ensured the client received the appropriate share of the surplus after valid senior claims were satisfied.
