In North Carolina, surplus funds from foreclosure sales are held by the Clerk of Superior Court in the county where the property was located. There is no central state agency that aggregates all surplus funds into a single searchable database.
That means to find surplus funds, you need to check in the right county — and you can do it for free.
How to Check for Surplus Funds in Any NC County
- 1Identify the county
Surplus funds are held in the county where the foreclosed property was located — not where you live now.
- 2Search NC eCourts (Odyssey)
Go to nccourts.gov and search for your foreclosure case by name, address, or case number. Look for a Special Proceeding (SP) case. The case file will show the sale amount and amounts applied to the debt.
- 3Contact the Clerk of Superior Court
Call or visit the Clerk of Superior Court in that county and ask whether surplus funds are on deposit in your case. This is a public record and the Clerk is required to provide this information.
- 4Review the case file
The case file will show all parties who have filed claims, the amounts on deposit, and the current status of the case.
